Welcome to SCAP Athletics. Please read these Terms of Service ("Terms") carefully before placing an order or using our website. By accessing scapathletics.com or purchasing any SCAP Athletics product, you agree to be bound by these Terms.

1. About SCAP Athletics

SCAP Athletics ("SCAP," "we," "us," or "our") is a sports recovery hardware company that designs and sells physical recovery tools, including the ScapStick. Our products are intended to support mobility, recovery, and shoulder health for athletes and active individuals.

2. Eligibility

By using this site, you represent that you have the legal capacity to enter into a binding agreement, or that you have the consent of a parent or guardian if required under applicable law. If you are placing an order on behalf of a team, organization, or business, you represent that you have the authority to bind that entity to these Terms.

3. Products and Descriptions

We make every effort to display our products accurately, including images, descriptions, and dimensions. However, we do not guarantee that product descriptions or other content on the site are complete, reliable, or error-free. Colors and physical characteristics may vary slightly from what is shown on screen.

Product availability is not guaranteed. We reserve the right to limit quantities, discontinue products, or modify product specifications at any time without prior notice.

4. Pricing

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors at any time. If a pricing error is discovered after you have placed an order, we will contact you before processing or shipping and give you the option to confirm the order at the correct price or cancel it for a full refund.

Sales tax, if applicable, will be calculated at checkout based on your shipping address.

5. Pre-Orders

Some SCAP Athletics products may be offered on a pre-order basis, with an estimated ship date provided at the time of purchase. Pre-order ship dates are estimates and are subject to change. By placing a pre-order, you acknowledge that your product has not yet shipped and that fulfillment is contingent on production timelines.

We will communicate updates regarding pre-order status via the email address provided at checkout. If you have questions about your pre-order, contact us at support@scapathletics.com.

6. Orders and Payment

By placing an order, you are making an offer to purchase the selected product(s) at the listed price. We reserve the right to accept or decline any order at our discretion. An order is confirmed once you receive an order confirmation email from us.

We accept major credit cards and any other payment methods listed at checkout. Payment is due at the time of order. All transactions are processed securely through Shopify's payment infrastructure.

7. Shipping

We ship to addresses within the United States and select international destinations. Shipping rates and estimated delivery times are displayed at checkout. We are not responsible for delays caused by carriers, customs, or circumstances outside our control.

Risk of loss and title for products pass to you upon delivery to the carrier. If your order is lost in transit, please contact us at support@scapathletics.com and we will work with you to resolve the issue.

8. Returns and Refunds

We stand behind our products. If you are not satisfied with your purchase, please contact us within 30 days of delivery to initiate a return.

To be eligible for a return:

  • The product must be in its original condition and packaging.
  • The product must not have been used beyond initial evaluation.

Once your return is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within 5–10 business days.

We do not accept returns on products that are damaged due to misuse, neglect, or unauthorized modification.

Note for pre-orders: Pre-order cancellations are accepted any time before the order ships. Once shipped, standard return terms apply.

9. Not Medical Advice

SCAP Athletics products are designed to support shoulder mobility and muscle recovery for athletes and active individuals. They are not intended to diagnose, treat, cure, or prevent any medical condition or injury.

Nothing on this website or in any product materials constitutes medical advice. You should consult a qualified healthcare professional before using any recovery tool, particularly if you have a pre-existing injury, medical condition, or are recovering from surgery.

Use of SCAP Athletics products is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, SCAP Athletics and its founders, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of our products, including but not limited to personal injury, property damage, or loss of data.

Our total liability to you for any claim arising from the purchase or use of a SCAP Athletics product shall not exceed the amount you paid for that product.

Some states do not allow limitations on implied warranties or exclusions of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless SCAP Athletics and its affiliated parties from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of our products, your violation of these Terms, or your violation of any third-party rights.

12. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, product designs, and images, is the property of SCAP Athletics and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any SCAP Athletics content without our express written permission.

13. Privacy

Your use of our website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect and use your information.

14. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the site or purchase of our products after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in New Jersey.
